Terms and Conditions

  1. Protect your card like it is cash.
  2. This card has no expiry date and no activation, non-usage, service or other fees will apply unless permitted by law.
  3. Gift cards are not returnable or redeemable for cash except in provinces where required by law.
  4. Gift cards are not debit or credit cards and can only be used to purchase merchandise at Turnberry Isle Miami. Gift cards cannot be used to purchase additional gift cards, but may be used in conjunction with other coupons or certificates. No credit card, credit line, overdraft protection, or deposit account is associated with gift cards. Cards must be presented at the time of payment to either the cashier or server.
  5. Gift cards can be purchased in any amount up to a maximum of $1,000.00 and all amounts are in USD.
  6. Balances of registered cards can be confirmed at any time by visiting online, or by calling 305.932.6200. Card holders will not be sent account statements.
  7. Unused gift card balances may be transferred to another card.
  8. Taxes are not applied on the purchase of gift cards, but applicable taxes will be charged on the merchandise/service purchased with the card.
  9. Turnberry Isle Miami gift cards can be purchased or reloaded on property or online. Gift cards can be purchased in restaurants/spa/golf shop using cash, debit card or approved credit card and on-line with an approved credit card. The purchased amount will be applied against the gift card immediately.
  10. Purchases are deducted from the card until the balance reaches zero dollars. If the value of the card is less than the amount of the total purchase, the balance of the purchase price must be paid in order to complete the purchase. If the value of the card is greater than the amount of the total purchase, the unused balance will remain on the card for future purchases.
  11. We reserve the right to correct the balance of your gift card if in our sole discretion we believe that a clerical, billing or accounting error occurred. We shall have no liability for any billing error unless you provide us notice within sixty (60) days of the date of the transaction in question. You should review your card transactions and account balances closely.
  12. Cards can be registered online at www.turnberryislemiami.com/giftcards or by calling 305-932.6200. Upon registering your card, you will receive a confirmation email from us containing information for managing your account.
  13. If the card is lost, damaged or stolen, but has been registered, the balance remaining on the card at the date we are notified will be restored to your card, including reloads or verifications. Any amounts on the card that are used prior to notification will not be replaced. Cards that are lost, damaged or stolen and not registered will be ineligible for replacement and any associated balances will not be refunded. Please contact Turnberry Isle Miami at 305.932.6200 in order to notify us regarding a lost, damaged or stolen card which has been registered. A new card will be forwarded to you in seven to ten business days (provided that the original card was registered).
  14. The card is the property of Turnberry Isle Miami and must be returned upon request. Turnberry Isle Miami will not accept a card if in their sole discretion they believe it has been obtained by fraud or theft and reserves the right to cancel such cards.
  15. These Terms and Conditions will govern the use of the card by the purchaser/recipient and all subsequent known or unknown recipients or holders of the card.
  16. Use of the gift card is subject to all applicable laws and regulations. These Terms and Conditions and their application and interpretation will be governed by the laws of Florida without regard to conflict of law rules, and are subject to change without notice.
  17. If a court of competent jurisdiction determines that any term, condition or provision of these Terms and Conditions is illegal, invalid or unenforceable, that term, condition or provision shall be severed from these Terms and Conditions and the remaining terms, conditions and provisions shall remain in full force and effect.
  18. Turnberry Isle Miami representatives and employees make no representations, warranties or conditions of any kind, express or implied, with respect to the Turnberry gift cards, including but not limited to, any express or implied warranty of merchantability, accessibility, acceptance, or fitness for a particular purpose to the maximum extent permitted by law. In the event a card is non-functional, Turnberry Isle Miami shall only be liable for the replacement of the gift card. If Turnberry Isle Miami, affiliates or their respective agents, representatives and employees is found liable to a card holder, the holder can only recover actun al and direct damages not exceeding the last balance held on the registered gift card. To the maximum extent permitted by law, Turnberry Isle Miami is not liable for any incidental, indirect or consequential damages arising out of or in connection with the gift card.
  19. Any dispute, claim, question or disagreement arising out of or in connection with Turnberry gift cards shall be submitted to confidential arbitration and resolved in such form and pursuant to such rules as Turnberry Isle Miami and the card holder may agree upon or, in the absence of such agreement, by a single arbitrator appointed pursuant to the laws and rules relating to commercial arbitration in the province or territory in which the card holder resides. The arbitrator's award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
  20. To request arbitration of any dispute, claim, question or disagreement, a card holder must present to Turnberry Isle Miami a notice to arbitrate and written details of the claim. If Turnberry Isle Miami wishes to arbitrate against a card holder, it will deliver a notice to arbitrate and written details of the claim to the card holder's last known address or, if the last known address is not known to Turnberry Isle Miami, the details and notice will be published in the daily newspaper of the city, town or municipality where the card holder was last known to reside.
  21. Gift cards and their use are subject to the privacy policy of Turnberry Isle Miami which is available for review at www.turnberryislemiami.com/giftcards.
  22. Use of the card constitutes acceptance of these Terms and Conditions, which may change without notice.
